Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website and the purchase of any products from L’Avenue Atelier, a brand operated by L’Avenue Atelier Limited, a company registered in Hong Kong SAR (“L’Avenue Atelier”, “we”, “us” or “our”). By browsing the Site or placing an order, you (“you”, “the customer”) agree to these Terms in full.

1. Interpretation and our final say

L’Avenue Atelier has sole and final say over the interpretation and application of these Terms. Where any provision, product description, order, promotion, remedy or dispute is capable of more than one meaning, or where these Terms are silent, our reasonable determination shall prevail.

Without limiting the above, L’Avenue Atelier reserves the right, acting reasonably and at its sole discretion, to make the final decision on:

whether a product conforms to its description, and in particular whether a characteristic of a piece is natural stone variation or a genuine defect;
whether to accept, reject, cancel or amend any order;
eligibility for any refund, replacement, remedy, discount or goodwill gesture;
the meaning and scope of any offer, promotion or published information; and
any matter these Terms do not expressly address.

Our exercise of this discretion does not remove any rights you have that cannot be excluded under the laws of Hong Kong SAR.

2. Eligibility and accounts

You must be at least 18 years old and able to enter into a legally binding contract to purchase from us. If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. You agree to provide accurate, current and complete information, including a correct and complete delivery address.

3. Products, natural stone and photography

Every L’Avenue Atelier product is made from natural stone, and no two pieces are identical. Natural marble and other stones are formed over millions of years, and as a result each piece has its own colour, tone, veining, movement, markings and pattern. Variation in colour and veining is an inherent and celebrated quality of natural stone — it is the mark of authenticity, not a fault.

Different stones have different colours. Even within the same stone type, shade and veining will differ from block to block and from piece to piece. The stone you receive will not match any photograph, sample, swatch or previously purchased item exactly.

Images are illustrative only — do not rely strictly on the photograph. All photographs, renderings, samples and swatches on the Site are provided to give a general impression of a product and its style. They are:

representative, not exact: the actual colour, veining and pattern of your piece will differ from what is shown;
affected by screen, monitor and device settings, which can alter how colours appear; and
not a guarantee of the precise appearance of the item delivered.

By ordering, you acknowledge and accept these natural variations, and you agree that they do not constitute a defect and are not grounds for rejection, return or refund. L’Avenue Atelier shall have the final say as to whether the appearance of a delivered piece falls within the normal range of natural stone variation.

4. Prices and payment

All prices are shown in USD and are subject to change at any time before we accept your order. While we take care to price accurately, errors may occur; where a product’s correct price differs from the price shown, we may cancel the order at our sole discretion, even after it has been acknowledged, and will refund any amount already paid. Payment is taken through our third-party payment providers at the time of order. You are responsible for any import duties, taxes, customs charges or clearance fees imposed by the destination country.

5. Orders and acceptance

Your order is an offer to buy. All orders are subject to acceptance by us, and we may accept or decline any order at our sole discretion (for example, where stock is unavailable, where we cannot deliver to your location, where a pricing error has occurred, or where we suspect fraud). A binding contract is formed only when we confirm dispatch of the products, not when you receive an order acknowledgement.

6. Shipping and delivery

All delivery dates and timelines are estimates only and are not guaranteed. Because our pieces are heavy natural-stone goods shipped internationally, delivery involves several stages outside our full control, and you agree that a reasonable margin applies to every stage.

Sea-freight / boat schedules. Where goods travel by sea, the delivery timeline depends on the actual sailing and arrival times of the vessel, which can shift due to weather, sea conditions, port congestion, carrier scheduling and customs clearance. Estimated delivery days are therefore given with a margin and may move earlier or later than first indicated.

Final-mile and car delivery. The final stage of delivery — by road or car to your address — depends on the:

exact address and location where you (the client) live or wish to receive the goods, including its accessibility, distance from the port or hub, local access restrictions, and available delivery windows;
ability to safely access, park, unload and carry heavy stone items to the delivery point.

For these reasons, the number of days quoted for delivery carries a margin and should be treated as a good-faith estimate rather than a fixed date. L’Avenue Atelier will determine, acting reasonably and at its final discretion, the delivery method, routing and schedule appropriate to your location.

You are responsible for providing a complete, accurate delivery address and for ensuring someone is available to receive and inspect the goods. Failed deliveries, re-deliveries or storage caused by incorrect address details or lack of access may incur additional charges.

7. Risk, title and inspection on delivery

Risk in the products passes to you on delivery. Title passes once we have received payment in full. Please inspect your goods on delivery. Any visible damage or shortage must be noted at the point of delivery where possible and reported to us in writing within 48 hours of receipt, with supporting photographs. We will assess any such claim and make the final determination as to whether the issue is transit damage, a manufacturing defect, or natural stone variation.

8. Returns, cancellations and refunds

Many of our pieces are made to order or selected individually from natural stone. Except where you have a non-excludable legal right to cancel, natural variation in colour, veining or pattern is not a valid reason for return. Where a return is accepted, items must be unused, undamaged and in original packaging. Bespoke, customised and made-to-order pieces may be non-returnable. All refund, replacement and remedy decisions are made by L’Avenue Atelier at its final discretion, consistent with your non-excludable statutory rights.

9. Warranties and limitation of liability

We warrant that products will, at delivery, materially correspond to their description, subject always to the natural characteristics of stone described in Section 3. To the fullest extent permitted by law, all other warranties, conditions and terms implied by statute or common law are excluded. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded. Subject to that, our total liability arising out of any order shall not exceed the price paid for the products in question, and we shall not be liable for indirect or consequential loss.

10. Intellectual property

All content on the Site — including the L’Avenue Atelier name, logo, product designs, photographs, text and layout — is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, republish or use any of it without our prior written permission.

11. Acceptable use

You agree not to use the Site unlawfully, to introduce malicious code, to attempt to gain unauthorised access, or to misuse the Site in any way that could damage it or impair its availability. We may suspend or withdraw access at our discretion.

12. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including weather, natural events, shipping and port disruption, customs action, strikes, or acts of government.

13. Privacy

Our handling of your personal data is described in our Privacy Policy, which forms part of these Terms.

14. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or any order, are governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China. You and L’Avenue Atelier submit to the exclusive jurisdiction of the courts of Hong Kong SAR. This applies regardless of where in the world you access the Site or receive the goods.

15. Changes to these Terms

We may update these Terms at any time at our discretion. The version in force at the time you place an order applies to that order. The current version is always available on the Site.

16. General

If any provision is found unenforceable, the remaining provisions continue in force. Our failure to enforce a right is not a waiver of it. You may not assign your rights without our consent; we may assign ours. These Terms are the entire agreement between us regarding their subject matter.
